KIVVO TERMS

Terms of Service

These terms set out the agreement between you and Kivvo when you use our savings app. Please read them carefully. By creating an account or using Kivvo, you agree to these terms.

If you don't agree with these terms, please don't use Kivvo.

The short version

Kivvo is a savings app. It helps you set goals and contribute toward them on a schedule.

Kivvo is not a bank, not a financial adviser, and not a financial product provider. See our Financial Services Disclosures for detail.

You must be 16 or older, and a New Zealand resident, to use Kivvo.

You're responsible for your account and for keeping your login details secure.

Contributions are your money. Kivvo doesn't take custody of your funds — they're handled through licensed third-party providers.

You agree to our other policies — Privacy, Cookies, Acceptable Use, Contribution Terms, Kivvo+ Terms, Payouts Policy, Fees & Charges.

Kivvo is a very small New Zealand company — currently two people — building early-stage software.

We can suspend or close your account if you breach these terms.

We can update these terms, and we'll tell you about material changes.

1. Who we are

Kivvo is a small New Zealand company providing a savings application. When these terms say "we", "us", or "Kivvo", they mean the Kivvo entity responsible for providing the service.

Because Kivvo is early-stage and small, some aspects of the service are still evolving. We're honest about that, and we ask you to read these terms with that context.

2. Eligibility

To use Kivvo, you must:

Be 16 years of age or older

Be a New Zealand resident

Be legally capable of entering into a binding contract

Not be subject to sanctions imposed by New Zealand, the United Nations, or any relevant jurisdiction

Not have had a previous Kivvo account closed by us for breach of these terms

If you don't meet all of these requirements, you must not use Kivvo.

We may ask you to verify your eligibility at any time. If we can't verify your eligibility, or if we believe you don't meet these requirements, we may suspend or close your account.

3. Your account

Creating an account

You create a Kivvo account by providing the information we ask for — typically an email address, a display name, and a password. You must provide accurate information.

One account per person

You may only maintain one Kivvo account per person, unless we agree otherwise in writing.

Keeping your account secure

You're responsible for:

Keeping your password and login credentials secure

All activity that happens under your account

Telling us promptly if you believe your account has been compromised

If you believe someone else has access to your account, please submit a support ticket via the Support page immediately.

Accurate information

You agree to keep the information on your account accurate and up to date, including your email address and payment details.

4. What Kivvo does

Kivvo provides a savings application that lets you:

Create savings goals with target amounts and dates

Set up scheduled contributions toward your goals

Make one-off contributions

Track your progress over time

Access Kivvo Payouts (cashback), where eligible

Access Kivvo+ features, if you're a Kivvo+ member

Manage your account, preferences, and data

What Kivvo does not do

Kivvo does not:

Act as a bank or take deposits

Hold your funds on our own balance sheet

Pay interest

Provide financial advice

Offer any financial product

Provide investment, insurance, or lending services

For more detail, see our Financial Services Disclosures.

5. Contributions

Contributions are governed by our Contribution Terms, which form part of this agreement.

In summary:

Contributions are your money, moving toward your chosen goals.

Minimum contribution amounts apply ($50 weekly, $100 bi-weekly, $200 monthly, $10 per day for one-offs).

A contribution fee applies, as set out in our Fees & Charges.

Contributions are processed by our third-party payment provider.

Kivvo doesn't take custody of your funds.

Please read the full Contribution Terms for the complete picture.

6. Kivvo+

Kivvo+ is an optional paid membership with its own terms, which form part of this agreement.

In summary:

Kivvo+ is billed monthly or annually.

Subscriptions renew automatically unless you cancel.

You can cancel at any time; cancellation takes effect at the end of your current paid period.

Kivvo+ unlocks access to cashback (subject to eligibility), plus other features.

Please read the full Kivvo+ Membership Terms for the complete picture.

7. Kivvo Payouts (cashback)

Kivvo Payouts is a cashback feature that is currently limited to users who meet strict eligibility criteria. Its terms are set out in our Payouts Policy, which forms part of this agreement.

In summary:

Kivvo Payouts is limited to Kivvo+ members who also meet a minimum monthly contribution threshold and maintain a 6.5-week streak.

Cashback is credited to your Kivvo account when you qualify.

Cashback is credited from Kivvo's own fee revenue — you're not waiting for Kivvo to release funds that belong to you.

The feature is in a limited rollout and may change.

Please read the full Payouts Policy for the complete picture.

8. Fees

Kivvo charges fees for certain services. These are set out in our Fees & Charges page, which forms part of this agreement.

In summary:

A contribution fee applies to scheduled contributions.

Kivvo+ has its own subscription fees.

Certain things are free — including creating goals, editing goals, and downloading your data.

Fees may change; we'll give you advance notice where a change affects you.

Please read the full Fees & Charges for the complete picture.

9. Your responsibilities

You agree to:

11. Intellectual property

Kivvo and its content — including the app, the website, the design, the code, the brand, and the text — are owned by Kivvo or its licensors and are protected by copyright and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use Kivvo for personal, non-commercial savings purposes, in accordance with these terms.

You must not:

Copy, modify, or distribute Kivvo's content without our permission

Use Kivvo's brand, logo, or name without our permission

Reverse engineer any part of Kivvo except where permitted by law

You retain ownership of any content you create in Kivvo (such as your goals and notes).

12. Availability of the service

We aim to keep Kivvo available and reliable, but we don't guarantee uninterrupted service.

Kivvo may be unavailable due to:

Maintenance or updates

Technical issues

Third-party service outages (for example, if our payment provider or hosting provider has an issue)

Events outside our reasonable control

We're a very small team, so response times to outages may be slower than at larger companies. We'll do our best to keep you informed.

We may modify, suspend, or discontinue parts of Kivvo at any time. Where a change is material, we'll notify you and, where appropriate, give you the option to cancel without penalty.

13. Suspension and termination

By you

You can close your account at any time by submitting a support ticket via the Support page.

When you close your account:

Your scheduled contributions stop.

Any active Kivvo+ subscription is cancelled.

Contributions already made remain allocated (subject to any final disbursement arrangements).

Some information is retained in accordance with our Privacy Policy.

We're required to by law

We believe your account is being used for fraud or unlawful activity

If we close your account without cause, we'll act reasonably and, where appropriate, give you notice.

Your breach of these terms

This indemnity doesn't apply to the extent the claim arises from our own negligence or breach.

17. Complaints and disputes

If you have a complaint, please see our Complaints Policy, which describes how we handle complaints and how to escalate them if you're not satisfied.

For disputes arising from these terms:

We'll try to resolve them with you directly first.

If we can't resolve them, the dispute will be handled in accordance with New Zealand law.

Where external escalation is appropriate, we'll tell you the relevant body.

18. Governing law

These terms are governed by the laws of New Zealand. You and we submit to the non-exclusive jurisdiction of the New Zealand courts.

We'll notify you where the change materially affects you.

Where a change requires your consent, we'll ask for it before the change applies.
